Fort Bend commissioners vote 4-0 for Tesla solar plant incentives, but Tesla has not committed to Texas
The county approved four incentive items for a 9,712-job solar cell plant, and the deal's terms show what Tesla would owe and when.

A 4-0 vote without a commitment
The county commissioners voted 4-0, and Tesla has not yet committed to building the plant in Texas [1]. For Fort Bend County residents, the vote sets terms for a project expected to create 9,712 full-time jobs and support more than 1,000 jobs during construction [2].
Interim County Judge Daniel Wong abstained because his engineering firm has worked with Tesla [1]. Tesla is considering multiple U.S. locations for the solar cell facility but did not disclose them beyond the Fort Bend County site [2].
What the commissioners approved
On October 22, the Fort Bend commissioners court approved items 25A to 25D: a Chapter 312 tax abatement, a Chapter 381 incentive agreement, a foreign trade zone agreement with a PILOT, and a 'true up' PILOT agreement [1]. Lamar CISD approved the school tax piece in September [1].
The abatement clock starts in tax year 2029 by default [1]. Tesla can move it to the first year after production starts, as late as 2031, without county approval [1].
Taxes, the foreign trade zone and the floor
Land and buildings are not covered by the abatement and remain fully taxable at all times, according to the agreement [1]. The site would be part of Port Freeport's Foreign-Trade Zone No. 149, which exempts eligible inventory from local property tax [1]. Tesla's PILOT payments are set at zero dollars or 0% of forgone taxes while the abatement is in effect [1].
The true-up agreement guarantees Fort Bend collects at least $2 million a year [1]. For scale, Tesla's consultant Kroll estimated the project would pay $276.5 million in Fort Bend County general taxes over 38 years without incentives, peaking at $16.2 million in 2030 [1].
Jobs and wage targets
The jobs ramp is 2,500, 5,000, 7,500, then 9,712 employees by the fourth year of operations, with an average compensation of $55 per hour [1]. Tesla receives the full abatement as long as it reaches 90% of the headcount target, about 8,741 people [1].
Missing a jobs or wage target for one year costs Tesla only that year's break [1]. Two misses in a row let the county terminate the agreement [1].
If Tesla averages at least 12,000 employees for any two consecutive years during the first decade, the first five years of the rebate period become a 100% grant [1]. The rebate period also stretches from 20 to 25 years, pushing the agreement to Project Year 35 [1].
Why the county offered it
Tesla's application says the economics of the Fort Bend site are 'not competitive' with an unnamed site in another state that lacks the JETI limitation and local abatements [1]. Without the JETI incentives, Tesla said the Fort Bend County site would not be as competitive as another unnamed site [2].
Fort Bend's economic development director, Carlos Guzman, told ABC13 the county 'would've been eliminated from consideration' without these agreements [1].
Solar history and ambitions
Tesla currently engineers its solar panels in California and assembles them in Buffalo, New York, with a capacity of more than 300 megawatts per year [2]. Elon Musk said at Davos in January that the SpaceX and Tesla team are each working to build toward 100 GW a year of manufactured solar power in the U.S. [1]
New York spent $950 million on Tesla's Buffalo factory for its solar business [1]. When solar plans fell apart, Tesla turned to other things, including data labeling for Autopilot, to meet employment requirements [1].
What it means for Fort Bend residents
If you live in Fort Bend County, the agreement keeps land and buildings fully taxable at all times [1]. It also guarantees the county at least $2 million a year [1].
Watch the jobs numbers: missing a target for one year costs Tesla only that year's break, and two misses in a row let the county terminate the agreement [1]. Also watch the start date, since Tesla can move the abatement clock as late as 2031 without county approval [1].
